WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK

Effective Date: July 20, 2026

This Waiver and Release of Liability ("Agreement") is entered into by and between the undersigned participant ("Participant") and Gail, Brickman Enterprises, LLC, Brickman Arts, LLC, and any related entities doing business as Move Thru Life (collectively, "Company," "we," "us," or "our").

By accessing, browsing, or using this website, any of its content, and/or participating in any classes, programs, retreats, workshops, events, videos, or other offerings provided or referenced by this site (collectively, the "Services"), Participant acknowledges and agrees to the following:

1. Not Medical Advice

The information and content on this site and in our Services are for educational and informational purposes only and are not medical, physical therapy, or mental health advice. Participant understands that:

  • No doctor–patient or therapist–client relationship is created by using this site or Services.

  • Participant should consult with a physician or qualified health professional before beginning any exercise, yoga, movement, or wellness program.

2. Assumption of Risk

Participant understands that yoga, aerial yoga, dance, Pilates, Zumba®, movement practices, retreats, workshops, and related activities involve inherent risks, including but not limited to:

  • Physical injury (minor or serious), illness, aggravation of existing conditions, or in rare cases, disability or death.

  • Emotional or mental discomfort that may arise from participation.

  • Additional risks associated with international travel and retreats, including retreats in Costa Rica, as described in Section 8 below.

Participant voluntarily chooses to participate in these activities and assumes full responsibility for all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to use of this site and/or participation in the Services.

3. Location of Services; Premises Acknowledgment

Services may be provided at Company's home-based studio, at third-party studios or facilities, outdoors, while traveling, or at any other location Participant chooses to access the Services (including Participant's own home). Participant acknowledges and agrees:

  • Home Studio. Company's studio is located in a private residence. Participant has had the opportunity to inspect the space and ask questions, and voluntarily assumes the risks associated with a residential setting, including but not limited to floor surfaces, stairs, furnishings, pets, and shared or limited space.

  • Other Locations. For Services accessed at any location not owned or operated by Company — including another studio or gym, an outdoor location, a hotel or retreat venue, or Participant's own home — Company has no control over and is not responsible for the condition, safety, or suitability of that location or its equipment. Participant is solely responsible for selecting and maintaining a safe environment.

  • This Agreement applies to Participant's use of the Services regardless of the physical location in which they occur.

4. Release of Liability

To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and agrees not to sue Gail, Brickman Enterprises, LLC, Brickman Arts, LLC, or any related entities doing business as Move Thru Life, including their owners, members, managers, employees, contractors, instructors, volunteers, and agents, for any and all claims, demands, causes of action, damages, losses, costs, or expenses (including attorneys' fees) arising out of or related to use of this website or participation in any Services, including claims based on negligence (other than gross negligence or willful misconduct where such releases are not permitted by law).

5. Indemnification

Participant agrees to indemnify, defend, and hold harmless the Company and its representatives from and against any and all claims, liabilities, damages, losses, and expenses arising out of or related to Participant's use of this site or Services, violation of this Agreement, or actions or omissions in connection with any activities related to the Services.

8. International Retreats & Travel (including Costa Rica)

Participant understands that retreats held outside the United States, including in Costa Rica, involve additional risks including differences in local medical care, foreign laws, and travel-related issues. Participant is required to carry travel insurance that includes emergency medical and evacuation coverage and is responsible for all necessary travel documentation.

9. Retreat Waiver

In addition to this general waiver, a separate retreat-specific waiver and release will apply to any retreats or travel experiences offered by the Company. Participation is subject to signing that specific waiver, which is in addition to this general Agreement.

15. Electronic Acceptance

Participant acknowledges that by checking the "I Agree" box or equivalent electronic mechanism, Participant is entering into a legally binding agreement to the same extent as a handwritten signature.
