WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK
Effective Date: July 20, 2026
This Waiver and Release of Liability ("Agreement") is entered into by and between the undersigned participant ("Participant") and Gail Brickman, individually, and Brickman Productions, LLC, d/b/a Move Thru Life (collectively, "Company," "we," "us," or "our"). By accessing, browsing, or using this website, any of its content, and/or participating in any classes, programs, retreats, workshops, events, videos, or other offerings provided or referenced by this site (collectively, the "Services"), Participant acknowledges and agrees to the following:
1. Not Medical Advice
The information and content on this site and in our Services are for educational and informational purposes only and are not medical, physical therapy, or mental health advice. Participant understands that:

No doctor–patient or therapist–client relationship is created by using this site or Services.

Participant should consult with a physician or qualified health professional before beginning any exercise, yoga, movement, or wellness program.
2. Assumption of Risk
Participant understands that yoga, aerial yoga, dance, Pilates, Zumba®, movement practices, retreats, workshops, adventure activities (including but not limited to surfing, zip-lining, horseback riding, ATV/quad excursions, hiking, snorkeling, and motorized vehicle transportation), and other activities described in retreat-specific waivers involve inherent risks, including but not limited to:
- Physical injury (minor or serious), illness, aggravation of existing conditions, or in rare cases, disability or death.
- Emotional or mental discomfort that may arise from participation.
- Additional risks associated with international travel and retreats, including retreats in Costa Rica, as described in Section 6 below and in the retreat-specific waiver referenced in Section 7.
Participant voluntarily chooses to participate in these activities and assumes full responsibility for all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to use of this site and/or participation in the Services
3. Location of Services; Premises Acknowledgment
Services may be provided at Company's home-based studio, at third-party studios or facilities, outdoors, while traveling, or at any other location Participant chooses to access the Services (including Participant's own home). Participant acknowledges and agrees:

Home Studio. Company's studio is located in a private residence. Participant has had the opportunity to inspect the space and ask questions, and voluntarily assumes the risks associated with a residential setting, including but not limited to floor surfaces, stairs, furnishings, pets, and shared or limited space.

Other Locations. For Services accessed at any location not owned or operated by Company — including another studio or gym, an outdoor location, a hotel or retreat venue, or Participant's own home — Company has no control over and is not responsible for the condition, safety, or suitability of that location or its equipment. Participant is solely responsible for selecting and maintaining a safe environment.

This Agreement applies to Participant's use of the Services regardless of the physical location in which they occur.
4. Release of Liability
To the fullest extent permitted by law, Participant hereby releases, waives, discharges, and agrees not to sue Gail Brickman, individually, and Brickman Productions, LLC, d/b/a Move Thru Life, including their owners, members, managers, employees, contractors, instructors, volunteers, and agents, for any and all claims, demands, causes of action, damages, losses, costs, or expenses (including attorneys' fees) arising out of or related to use of this website or participation in any Services, including claims based on negligence (other than gross negligence or willful misconduct where such releases are not permitted by law).
5. Indemnification
Participant agrees to indemnify, defend, and hold harmless the Company and its representatives from and against any and all claims, liabilities, damages, losses, and expenses arising out of or related to Participant's use of this site or Services, violation of this Agreement, or actions or omissions in connection with any activities related to the Services.
6. International Retreats & Travel (including Costa Rica)
Participant understands that retreats held outside the United States, including in Costa Rica, involve additional risks including differences in local medical care, foreign laws, and travel-related issues. Participant is required to carry comprehensive travel insurance that protects Participant's full investment, including flights, and that includes emergency medical and evacuation coverage, and is responsible for all necessary travel documentation. Comprehensive travel insurance is required to protect your full investment, including flights. All payments are non-refundable and non-transferable. If your spot is filled by another guest from the waiting list, you' will receive a full refund within 30 days of that spot being filled.
7. Force Majeure
Company is not liable for any delay, interruption, or cancellation of retreat or Service offerings due to circumstances beyond its reasonable control, including but not limited to natural disasters, political instability, global pandemics, airline cancellations, government travel advisories, or acts of God.
8. Retreat Waiver
In addition to this general waiver, a separate retreat-specific waiver and release will apply to any retreats or travel experiences offered by the Company. Participation is subject to signing that specific waiver, which is in addition to this general Agreement.
9. Media Release
Participant grants Company permission to use photographs, video, or audio recordings taken during Services or retreats for promotional, marketing, and educational purposes, including on websites, social media, brochures, and other materials. Participants who prefer not to be photographed or recorded must notify Company in writing in advance.
10. Governing Law
This Agreement shall be construed under the laws of the State of New Jersey. Venue for any legal action shall be in the state or federal courts of Union County, New Jersey.
11. Electronic Acceptance
Visitor acknowledges and agrees.that by continuing to view, browse, or otherwise use this website, or by remaining on any page of this website, and/or by checking the "I Agree" box or other equivalent electronic mechanism where presented, Participant is entering into a legally binding agreement to the same extent as a handwritten signature.
